Mandatory Consent Before Booking
By ticking this box and proceeding with payment, I confirm and agree to the following:
1. Age Eligibility (Strict Requirement)
I confirm that I am 18 years of age or older.
I understand that participation in EM Tours and EM Schools is strictly restricted to individuals aged 18 and above.
If I provide false age information, EM reserves the right to cancel my booking without refund.
2. Assumption of Risk
I understand that motorcycling and related activities — including tours, rides, races, training programs, track days, festivals, experiences, and associated travel — involve inherent risks including serious injury, permanent disability, property damage, or death.
I voluntarily choose to participate and fully accept all risks, whether foreseeable or unforeseeable.
3. No Liability for Injury or Death
To the fullest extent permitted under applicable law, I expressly agree that Everything Motorcycling (EM), its founders, directors, employees, affiliates, partners, sponsors, agents, and platform operators shall not be held liable or responsible for:
- Any accident
- Personal injury
- Disability
- Loss of life
- Property damage
- Financial loss
Arising out of or related to my participation, whether caused by inherent risks, road conditions, weather, mechanical failure, third parties, or my own actions.
Nothing in this clause excludes liability arising from gross negligence, wilful misconduct, or fraud where such exclusion is prohibited under applicable law.
4. Third-Party Services
I understand that EM operates as a technology platform connecting riders with independent tour operators, schools, event hosts, accommodation providers, brands, and vendors.
I acknowledge that EM is not responsible for the acts, omissions, negligence, safety practices, or service execution of third-party providers.
5. Motorcycle Roadworthiness
I confirm that:
- My motorcycle is legally registered and insured (where applicable).
- My vehicle is in safe and roadworthy condition.
- I am solely responsible for maintenance, inspection, and safe operation of my vehicle.
6. Fitness & Legal Compliance
I confirm that:
- I hold a valid driving license where required.
- I am physically and mentally fit to participate.
- I will comply with all traffic laws and safety instructions.
- I will not participate under the influence of alcohol or prohibited substances (except where legally permitted in designated festival zones).
7. Emergency Medical Consent
In the event of injury or medical emergency, I authorize EM or its partners to arrange emergency medical treatment on my behalf.
I understand and agree that all medical expenses shall be borne solely by me.
8. Property Damage Responsibility
I accept full responsibility for:
- Any damage caused by me to third parties
- Damage to vehicles
- Damage to event infrastructure
- Damage to accommodation property
- Damage to sponsor or vendor property
I agree to indemnify EM for any such losses.
9. Removal for Unsafe Conduct
EM reserves the right to remove or disqualify any participant for unsafe, unlawful, reckless, or disruptive behavior without refund.
10. Insurance Responsibility
I understand that EM does not automatically provide health, accident, travel, or vehicle insurance unless explicitly stated.
I am responsible for arranging my own adequate insurance coverage.
11. Media & Promotional Consent
I grant EM the right to use photographs, videos, recordings, and media captured during participation for marketing, promotional, and commercial purposes without compensation.
12. Force Majeure
I understand that EM shall not be liable for cancellation, delay, or modification due to circumstances beyond reasonable control, including but not limited to weather, natural disasters, government restrictions, civil unrest, or emergencies.
13. Indemnification
I agree to indemnify and hold harmless EM from any claims, liabilities, damages, or legal expenses arising from:
- My participation
- My negligence or misconduct
- My violation of applicable laws
14. Binding Agreement
By ticking this box, I confirm that:
- I have read and understood this waiver.
- I voluntarily agree to all terms.
- This agreement is legally binding upon me and my legal heirs.
- I am making this declaration freely and without coercion.
