1. About EM & the Platform
These Terms and Conditions (“Terms”) govern your access to and use of the EverythingMotorcycling.com platform (“Platform”) operated by Everything Motorcycling Private Limited (“EM,” “we,” “us,” or “our”), a company incorporated under the Companies Act, 2013, with its registered office at First Floor, Alcove Building, GoodEarth Malhar Avenue, Kambipura, Kengeri, Bengaluru – 560076.
By accessing the Platform, creating an account, or making any booking or purchase, you agree to be bound by these Terms in full. If you do not agree, please do not use the Platform.
EM’s Role
For accommodation and tours, EM operates as an intermediary marketplace, facilitating discovery and booking between you (the guest or participant) and third-party property owners and tour operators (“Partners”). EM is not itself the property owner, tour operator, or training provider unless explicitly stated. For training courses listed and delivered directly by EM, EM acts as the service provider.
2. Eligibility
- You must be at least 18 years of age to create an account or make a booking on the Platform
- Participants under 18 may attend certain activities only when accompanied by a parent or legal guardian who accepts these Terms on their behalf
- For tours, you must hold a valid motorcycle driving licence appropriate for the vehicle being ridden
- You must provide accurate, complete, and current information when registering or booking
- By using the Platform you represent that you meet all eligibility requirements
3. Accounts & Registration
Creating an Account
Certain features of the Platform require you to register for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@everythingmotorcycling.com if you suspect unauthorised access.
Account Suspension
EM reserves the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or is used in a manner that may cause harm to EM, its Partners, or other users.
4. Bookings & Payments
Booking Confirmation
A booking is confirmed only upon receipt of the required payment and issuance of a written confirmation by EM to your registered email address. Confirmation emails are sent within 24–48 hours of successful payment.
Pricing & GST
All prices displayed on the Platform are inclusive of applicable GST unless stated otherwise. GST-compliant invoices are issued to your registered email upon booking confirmation. For B2B purchases requiring a business invoice, please provide your GSTIN at the time of checkout.
Payment Methods
We accept UPI, credit/debit cards, net banking, and digital wallets. All online payments are processed through RBI-compliant, PCI-DSS certified payment gateways. EM does not store full card details on its servers.
Cancellations & Refunds
All cancellation and refund terms are governed by our Cancellation & Refund Policy, which forms part of these Terms and is available at www.everythingmotorcycling.com/cancellation-policy.
Off-Platform Transactions
Any transaction, arrangement, or payment made directly between you and a Partner outside the EM Platform is not recognised by EM. EM will not be responsible for any losses, disputes, or service failures arising from such off-platform dealings.
5. Accommodation
EM’s Role
EM lists and facilitates bookings for rider-friendly properties. The property owner or operator (“Partner”) is solely responsible for the condition, safety, maintenance, and lawful operation of the accommodation. EM makes no guarantee as to the quality or fitness of any listed property beyond what is represented in the listing.
Booking & Check-In
- A booking is confirmed only upon receipt of payment and written confirmation from EM
- A valid government-issued photo ID (Aadhaar card, passport, or driving licence) must be presented at check-in, as required under Indian hotel regulations
- Check-in and check-out times are governed by the individual property’s policy. Early check-in or late check-out cannot be guaranteed and must be arranged directly with the property in advance
Guest Obligations
- Guests must comply with the property’s house rules at all times
- Any damage caused to the property, its fixtures, or fittings by a guest is the sole financial responsibility of that guest and may be recovered by the Partner directly
- Properties may refuse accommodation to intoxicated, unruly, or disruptive guests without refund
- Guests must not use the accommodation for any unlawful purpose
Disclaimer
EM is not responsible for loss of or damage to your personal belongings during a stay. Property standards may vary, particularly in remote, mountainous, or off-grid locations. EM endeavours to list accurate property information but cannot guarantee that all details remain current at the time of your stay.
Overbooking & Denied Stay
If a confirmed booking cannot be honoured by the property due to overbooking or reasons within the Partner’s control, the Partner is required to arrange equivalent alternate accommodation at their own cost or bear the full refund to you. EM will manage this process on your behalf.
6. Schools & Training Courses
Enrolment & Confirmation
Enrolment in a training course is confirmed upon receipt of payment and a written confirmation from EM. Course content, curriculum, duration, and instructors are determined by the training provider and may be subject to change with reasonable advance notice.
Participant Requirements
- Participants must follow all safety instructions from instructors and training staff at all times
- Appropriate riding gear — including a BIS-certified helmet — must be worn during all practical on-bike sessions
- Participants must disclose any medical condition or physical limitation that may affect their ability to participate safely before the course begins
- Participants must arrive on time. Late arrivals may be refused participation without refund at the discretion of the training provider
- EM and the training provider jointly reserve the right to exclude any participant deemed physically unfit, impaired, or a safety risk to themselves or others, without refund
Certificates & Results
Where a course results in a certificate, assessment score, or qualification, such outcomes are determined solely by the training provider based on participant performance. EM makes no guarantee as to the outcome of any training course.
If a Course Is Cancelled or Rescheduled by Us
If EM or the training provider cancels or reschedules a course, enrolled participants will be offered the choice of a full refund or a free transfer to the next available batch. We will notify you at least 48 hours in advance wherever possible.
7. Tours
EM’s Role
EM facilitates bookings for motorcycle tours operated by licensed third-party Partners. The Partner is solely responsible for participant safety, route planning, vehicle maintenance, guide conduct, and the overall operation of the tour. EM does not itself operate tours unless explicitly stated.
Booking & Confirmation
- A tour booking is confirmed only upon receipt of payment and written confirmation from EM
- All communications regarding bookings, modifications, or cancellations must be made exclusively through EM’s platform or approved channels
- Direct arrangements or payments made between you and the tour operator outside the EM platform are not recognised by EM
Participant Requirements
- All riders must hold a valid motorcycle driving licence appropriate for the vehicle being ridden on the tour
- Participants under 18 years of age may only participate as pillions with a licensed and insured adult rider, and require prior written consent from a parent or legal guardian
- Riding or being present on the tour route under the influence of alcohol or any intoxicant is strictly prohibited and will result in immediate removal from the tour without refund
- A BIS-certified helmet and appropriate protective riding gear must be worn at all times while on the tour
- Participants must follow all instructions from the tour lead or marshal at all times
- Participants must attend all pre-tour briefings as scheduled by the operator
Participant Waiver & Medical Declaration
All tour participants are required to complete and submit a signed or digitally accepted Participant Waiver and Medical Declaration before their booking is confirmed. This declaration must confirm that the participant is physically fit, holds a valid riding licence, has no medical condition that may impair their safety, voluntarily assumes the inherent risks of motorcycle touring, and consents to emergency medical treatment if required. Failure to complete the waiver will result in the booking being cancelled without refund.
Insurance
Personal travel and medical insurance is not included in any tour booking and is the sole responsibility of the participant. EM strongly recommends that all participants hold a comprehensive policy covering personal accident, medical evacuation, emergency hospitalisation, and trip cancellation before undertaking any tour.
Minimum Participant Requirement
Some tours require a minimum number of participants to operate viably. If this minimum is not met, EM will notify all affected participants at least 5 days before the scheduled tour start date and offer a full refund or a transfer to an alternative date.
Tour Modifications
Any change to the confirmed itinerary, route, inclusions, or timing after booking confirmation must be pre-approved by EM. Unapproved unilateral changes by the operator constitute a breach and affected participants will be entitled to appropriate remedies including a full refund.
8. Liability & Risk
⚠ IMPORTANT — Please read this clause carefully before booking any tour or training course. By confirming a booking, you acknowledge and accept the terms set out below.
Inherent Risks of Motorcycling
Motorcycling and motorcycle touring involve inherent and unavoidable risks. These include but are not limited to:
- Personal injury, including serious, permanent, or disabling injury
- Death
- Property damage or loss
- Risks arising from the actions of other road users, participants, or third parties
- Risks arising from road conditions, weather, terrain, mechanical failure, or wildlife
- Risks from participating in remote locations where access to emergency medical care may be significantly delayed
By booking any tour through EM, you voluntarily assume all such inherent risks and acknowledge that no amount of care, instruction, or precaution can entirely eliminate them.
Accidents, Injury & Death During Tours
In the event of an accident, injury, or death occurring during a tour booked through EM, the following applies:
- The tour operator (Partner) is primarily responsible for participant safety and for complying with all applicable safety standards and regulations under the Motor Vehicles Act, 1988, State Tourism Rules, and the Central & State Adventure Tourism Safety Guidelines, 2021
- EM must be notified of any serious incident — including any accident, significant injury, or death — within 12 hours of occurrence, along with a written incident summary and any police report (FIR) if applicable
- Emergency medical treatment will be sought immediately upon any incident. By booking a tour, you consent to emergency medical treatment being administered to you if you are unable to consent at the time
- All costs arising from emergency medical treatment, hospitalisation, evacuation, repatriation, or any other incident-related expenses are the sole financial responsibility of the participant and their insurers. EM will not bear such costs
- In the event of a participant’s death during a tour, EM will cooperate fully with the relevant authorities, the tour operator, and the participant’s next of kin. EM will notify the emergency contact provided at the time of booking as promptly as practicable. Any unused and non-refundable portion of the booking fee may be considered for a compassionate refund at EM’s sole discretion, after all legal, investigative, and administrative obligations have been satisfied
- EM strongly urges every tour participant to hold comprehensive personal accident and medical insurance that explicitly covers motorcycle touring activities, emergency medical evacuation, and repatriation of remains, before undertaking any tour
Emergency Contact Obligation
All participants must provide accurate next-of-kin emergency contact details — including name, relationship, and mobile number — and their blood group at the time of booking. This information will be shared with the tour operator and used solely for emergency purposes. Failure to provide this information may result in your booking being cancelled.
EM’s Liability Cap
To the maximum extent permitted by applicable Indian law:
- EM is not liable for any indirect, consequential, incidental, or punitive loss or damage arising from your use of the Platform or participation in any activity booked through it
- EM is not liable for the acts, omissions, negligence, or misconduct of third-party Partners, tour operators, property owners, or their employees and agents
- EM’s total aggregate liability to any user in connection with any single booking shall not exceed the total amount paid by that user for that specific booking
Nothing in these Terms limits or excludes EM’s liability for death or personal injury caused directly and solely by EM’s own gross negligence or wilful misconduct, as determined by a court of competent jurisdiction.
Indemnity
You agree to indemnify, defend, and hold harmless Everything Motorcycling Private Limited, its directors, officers, employees, and agents from and against any and all claims, demands, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) your participation in any activity booked through the Platform; (c) your violation of any applicable law or regulation; or (d) any claim by a third party arising from your conduct.
9. Intellectual Property
All content on the Platform — including text, images, logos, graphics, videos, and software — is the property of Everything Motorcycling Private Limited or its licensors and is protected by applicable Indian and international intellectual property laws. You may not reproduce, distribute, modify, or commercially use any content from the Platform without prior written consent from EM.
10. User Conduct
You agree not to:
- Use the Platform for any unlawful, fraudulent, or harmful purpose
- Post false, misleading, or defamatory reviews or content
- Circumvent the Platform by arranging direct bookings or payments with Partners outside EM
- Interfere with or disrupt the Platform’s technical infrastructure
- Use automated tools to scrape, crawl, or extract data without authorisation
- Impersonate any person or misrepresent your affiliation with any entity
EM reserves the right to remove content and suspend or terminate accounts that violate these rules without prior notice.
11. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the Republic of India. Any dispute arising from or in connection with these Terms or your use of the Platform shall be:
- First attempted to be resolved amicably by contacting us at grievance@everythingmotorcycling.com within 30 days of the dispute arising
- If unresolved within 30 days, referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with seat and venue at Bengaluru, Karnataka, with proceedings conducted in English
- Subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, for enforcement and interim relief
12. Changes to These Terms
EM reserves the right to update or modify these Terms at any time. Changes will be posted on this page with a revised effective date. If we make material changes that significantly affect your rights or obligations, we will notify registered users by email at least 14 days before the changes take effect. Continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.
